Misdemeanors
If this is your first DUI charge, you could face criminal misdemeanor charges and may be ordered to pay fines of up to $1000. Recent changes in Mississippi law have made a provision for the non-adjudication of first-time DUI offenders. You will be monitored and go through a probationary period, but at the end of the probationary period, your DUI will expunged and there would be no official record of it unless you are charged with a second DUI within five years. In addition, the MS Dept. of Public Safety may suspend your license for at least three months upon conviction—and that’s separate from the immediate administrative suspension of your license if you refuse to submit to testing when you’re arrested.
