Traffic Violations
Despite their additional hours of training to become commercial truck drivers, truckers are prone to making the same mistakes as other drivers – speeding, texting while driving, drinking and driving, not paying attention, and driving recklessly or aggressively – but with much worse results. Tractor-trailers are more than 20 times heavier than passenger vehicles when loaded with cargo, so the force of their impact is often disastrous to the occupants of the smaller, lighter car. The size and weight of an 18-wheeler also make it harder to maneuver so that they need more stopping distance and reaction time to avoid a collision. For their part, negligent auto drivers not only make mistakes like speeding and distracted driving, but when it comes to driving around tractor-trailers, they don’t always give truckers the time and space they need to merge lanes or stop safely.

Even though liability insurance is required by law, Washington state ranks fifth in the country for having the most uninsured drivers. Over 20% of motorists – more than one in five drivers on Washington roads – are uninsured. If you have uninsured/underinsured motorist (UM/UIM) coverage on your auto policy, you can use your insurance if you are hit by an uninsured driver or if you are injured in a hit-and-run or phantom vehicle accident where another driver caused you to crash without actually impacting your vehicle, such as by swerving into your lane and then speeding off. UM/UIM can also help you maximize compensation if the other driver only carries minimal coverage that doesn’t meet your expenses and you have higher limits on your UM/UIM policy. You’ll still need to deal with insurance claims adjusters who will downplay the severity of the accident and try to settle your claim for less than it is worth.

Title VII of the Civil Rights Act of 1964 is a federal law that prohibits discrimination in employment on the basis of race, color, religion, sex, or national origin. Washington’s Law Against Discrimination is our state’s anti-discrimination law, and in many ways provides greater protection against discrimination than does Title VII. The Americans with Disabilities Act of 1990 is a federal law that protects individuals with disabilities in a number of realms, including employment. Another federal statute prohibiting discrimination against individuals with disabilities is the Rehabilitation Act of 1973, which prohibits discrimination by federal agencies or agencies that receive federal funding. The Age Discrimination in Employment Act, as its name suggests, prohibits employment discrimination based on age. The Family & Medical Leave Act provides job protection for many workers who miss work due to their own illness or that of a family member. In addition to these state and federal laws, many counties and cities have anti-discrimination ordinances that protect workers in those jurisdictions.

Premises liability refers to the responsibility of a property owner to provide reasonably safe premises for the safety of others on their property. This duty extends to all property open to the public, including stores, government buildings, municipal swimming pools, amusement parks and playgrounds, and even city streets and sidewalks. Places of accommodation, including hotels and casino resorts as well as apartments or rental properties, are covered as well. If an accident or injury occurs on these premises because the owner was somehow negligent in allowing the accident to occur, the injury victim can hold the property owner liable for the harm incurred, including compensation for medical bills, loss of income, pain and suffering, and other legal damages.

All automobile drivers in Washington state are required to carry liability insurance or proof of financial responsibility sufficient to cover $25,000 in personal injury damages they cause someone in a wreck, up to $50,000 if more than one person is injured, plus $10,000 for property damage they cause. Despite this law, over 20% of drivers don’t carry insurance, making Washington the number five state in the nation for having the most uninsured drivers.
