Wrongful Death

Traffic Violations
Our client, a college student, was involved in a significant intersectional collision in which both drivers, and their passengers, claimed they had a green light and therefore had the right of way. As such, the defendant denied liability. At their deposition, attorney Dan Stampone was able to prove the other driver was speeding at the time of the crash and therefore more likely to be found at fault. Attorney Stampone negotiated a $105,000 settlement despite contested liability.
Sex Crimes
Our client, a mental health patient, was sexually assaulted by an employee at an assisted living facility. The employee, a mental health technician, was performing a skin check of our client’s legs when the assault occurred. An internal investigation performed by the facility determined the claim was unfounded and the employee was reinstated to full work status. Six months later, the Department of Health discovered a previously unreported incident involving the employee and another patient. Our attorneys successfully argued the technician would have been fired before having the opportunity to assault our client had the facility properly reported, monitored, and investigated the alleged sexual assault of patients by staff.

$1.5M SETTLEMENT: In 2018, our client was working when the product he was using collapsed causing him to fall to the ground and injure his lumbar spine, cervical spine, and head. The case came to J.B. Dilsheimer, a partner at Stampone O’Brien Dilsheimer Law, on referral from another law firm that was handling the workers compensation aspect of the claim. It took only a short consultation with the client, and Dilsheimer knew he had a case. Unfortunately, it had significant challenges—the product had been thrown out, his client had pre-existing injuries, and he only had a little over a year before the statute of limitations was to expire.

Medical Malpractice
Our client, a 51-year-old bank teller, underwent a hysteroscopy with her OBGYN to remove and biopsy polyps in her uterus. During the procedure, the doctor negligently removed her ureter. This required an emergency 12-hour robotic repair surgery. The Defendants made several arguments including a claim that the injury was a known risk and acceptable complication of a difficult procedure.
