On December 18, 2011, I was looking at purchasing a used 2007 Corvette Convertible from Kerry GMC. I dealt with Flint on the phone who quoted me a price of $31,995. Flint call me back 30 minutes later to apologize that he quoted me the wrong price, the price was $34,995. I went that day to look at it. Flint was not there and I talked to Rob. Rob told me that I had to submit a credit check before I test drove the vehicle. Rob said he had to in order to make sure that I wasn't going to go "joy riding". I have perfect credit and thought that this was odd, but whatever. As I was about to go for the test drive Rob told me that he had to go along with me. I was there with my wife who wanted to go with me and we questioned this. I said I purchased a 2011 explorer that was worth more money and had no issues. Rob had to ask James to make sure it was okay. Rob came back and said that it was okay. As we were walking out the door to the car we heard James yell out of the back office did you make sure you got their driver's license, insurance, and phone number. He said it in a way that we felt like James thought we were going to steal the car. Even Rob gave a look of disgust. During the negotiation, Rob brought Rick over to work on the deal. After much back and forth, the sales manager James came over to work on it. Especially after seeing our credit score. We were unable to work out an agreement. My wife and I left with no ill feelings.



On December 20, 2011, at 11 am, I received a call from Rob wanting to know if we would be interested in taking the corvette at the price we were looking at spending. I said I would have to talk with my wife and I would let him know that night. At 7 pm, I called and spoke with Rick. I told Rick that I would accept the offer and would be in late the next day to sign the papers.



On December 21, 2011, I waited until 11:30 am and called the dealership because I had not heard from anyone. I spoke with Bev and indicated that I was looking for Rob. Bev said that Rob was with another customer and unable to talk but could she help. I said I was calling about the corvette that they had. I did not say who I was and she said the car had been sold. I believed that it was sold to me and asked that Rob call me. I did not receive a call from Rob and called the dealership again at 2 pm. I spoke with a salesman and he said that Rob had left. I told him that I was unsure if the corvette had been sold to me or not. This salesman said that he would call Rob and have him call me back. At 5 pm, I called the dealership back. This time I spoke with James. James asked me if I was the guy from Tennessee or the other guy. I was confused and said I guess I was the other guy. James said Kerry GMC sold the corvette to someone that had offered full price and was coming from Tennessee later that day to look at the car, but if I would like I could speak to the general manager and offer full price. I said its okay. At 5:30 pm, I decided to call and speak to the general manager to discuss the unethical sales practice. I was given James. James said that the general manager leaves at 4:30 pm and when the general manager leaves, he is then the general manager. James wanted to know what I wanted to discuss. I explained that I felt it was an unethical practice when we had a verbal agreement especially from a dealership that promotes customer service. James said that there was no agreement and that I said I would probably come in. I said that I spoke with Rick and I would be in after work. I told James I thought it was sad that his dealership couldn't have called me regarding the purchase of the vehicle. James said that everyone I had talked with from his dealership had told me that the car had sold. I told James that no one could tell me if the vehicle was purchased by someone other than me. James told me that the individual from Tennessee had put a deposit down and in his business he has to take the sure offer.
