Child Support
Child support is the amount of money that the court order one parent to the other parent every month for the support of the child or children. The State of California has a formula for figuring out how much child support should paid in all cases. Generally, child support payments are made until the child turns 18 or 19 if they are still in high school full time, living at home and cannot support themselves. You and your spouse may agree to support a child longer.
Child Custody and Visitation
Child custody and visitation indicates who your child or children will live with and how you and your spouse will share parenting responsibilities. When you and your spouse separate, the two of you must decide which parent your child or children will live with and how you two will share your parenting responsibilities. You and your spouse may make your own parenting agreement and it can be filed with court where the judge, who makes the final decision, usually approves the arrangement. However, if you and your spouse do not agree on a parenting plan, the two of you will be required to attend a mandatory parent education program and mediation. Mediation is provided at no-cost and gives you and your spouse the opportunity to discuss with a neutral health profession the best plan for your child or children. If you reach an agreement, the mediator will draft a custody and visitation plan. If you do not reach an agreement, the judge will have to make the decisions.

Guardianship
The setting up of a conservatorship is a court proceeding whereby an adult can obtain the legal right to make personal, financial, or legal decisions for another adult. In most states this procedure is called a guardianship. In California, it is referred to as a conservatorship. In California, a guardianship refers to the procedure to care for minors and their estates.
Spousal Support
Spousal support is a court order for one spouse to the other spouse a certain amount of support money each month. The judge will take many things into considerations when deciding what spousal support should be, including the length of your marriage, the age and health of you and your spouse, the income you and your spouse can ear on your own, the number of mine children at home, and the history of the way the you and your spouse handled money during your marriage.
Legal Separation
A court can order one spouse to make monthly payments of support to the other spouse when a couple legally separates or files for a dissolution. These payments are known as spousal support. These monthly payments used to be referred to as “alimony.” To begin a spousal support order, one of the following cases must be filed: an annulment, a dissolution, a legal separation or a domestic violence restraining order.

Trusts
A will is a traditional legal document which names individuals (or charitable organizations) who will receive your assets after your death, either by outright gift or in a trust, nominates an executor who will be appointed and supervised by the probate court to manage your estate; pay your debts, expenses and taxes and distribute your estate according to the instructions in your will and nominates guardians for your minor children. Most assets in your name alone at your death will be subject to your will. Some exceptions include securities accounts and bank accounts that have designated beneficiaries, life insurance policies, IRAs and other tax-deferred retirement plans, and some annuities. Such assets would pass directly to the beneficiaries and would not be included in your will. In addition, certain co-owned assets would pass directly to the surviving co-owner regardless of any instructions in your will. And assets that have been transferred to a revocable living trust would be distributed through the trust—not your will. For some, a California Statutory Will (a fill-in-the-blanks form) may be sufficient. This form can be printed out from the California State Bar Web site at www.calbar.ca.gov (go to Public Services and Making a Simple Will). Keep in mind, however, that you must execute your will in the manner required by California law. Failure to do so could invalidate the entire will. Power of Attorney
Creating a Power of Attorney is very simple and has plenty of benefits and advantages. This legal document allows you to give authorization to an individual, known as an agent (or attorney-in-fact), to mange your property and finances. The agent can take care of everyday tasks on your behalf while you are away or unable to do so yourself. It can last for a limited time and then expire or even a lifetime if you prefer. If “durable,” this legal document allows the appointed individual to handle your property and finances if you were to ever become incapacitated or incompetent.
