Child Support
Child support is based on the income of the parties. The basic notion is that the child should receive the same proportion of parental income he or she would have received if the parents lived together. Child support is calculated based on a published schedule or formula, which takes into account the combined income of the parties and the number of children they have.
Child Custody and Visitation
In mediation, the parents are able to discuss and come to an agreement modifying the terms of custody and visitation. This may mean that the non-custodial parent has larger blocks of time with the child during school breaks or that the parents share the transportation of the child for visitations.
Premarital Agreement
Preparing to marry the love of your life should be exciting, but there are also arrangements that must be established before the wedding — specifically the prenuptial agreement. In some cases, these arrangements can be completed afterward in a postnuptial agreement. Pre- and postnuptial agreements are legally binding contracts that clearly outline what will happen in the case of a divorce or separation.
Spousal Support
The purpose of alimony/spousal support is to have the spouse with the greater income contribute to the support of his or her former spouse. There is no absolute right to alimony/spousal support, but the Court “may” order either party to pay alimony/spousal support to the other. The amount of the support award is determined by the court after full disclosure of the financial conditions of the parties. Among the factors considered by courts in making this determination are the length of the marriage; the age, health and station of the parties; the occupation, amount and sources of their incomes; and the estate and needs of the parties. The length of time alimony/spousal support is to be paid is left to the discretion of the court, and in some cases courts may award lifetime support.
