Estate Planning
Wills
This is your Last Will and Testament. It cancels out any previous wills you may have made, names your EXECUTOR, and, if you have any minor children at death, names a GUARDIAN for them. However, this will does not give anything at death to your heirs. Rather, the Pourover Will is designed to distribute any assets not funded into your Living Trust to your Revocable Living Trust. This makes sure your assets are all given out by the terms of your Revocable Living Trust. In short, the beneficiary of this Will is your Trust.
Trusts
We prepare Quitclaim Deeds to transfer your real estate into your Living Trust, along with forms for the County Assessor to prevent a reassessment on your property. This prevents the Assessor from raising your property taxes when you record this deed.
Power of Attorney
When you have a Living Trust, you should also have a Durable Power of Attorney for Property Management, which will name someone to handle your assets and day-to-day financial affairs in case you are incapacitated. You should also have an Advance Health Care Directive (Living Will) and Durable Power of Attorney for Health Care, which allows someone you name to make health care decisions for you when you can’t, and, if necessary, to “Pull the plug”.
