Child Custody and Visitation
When CPS (or CWS) investigates you or a family you know, a social worker will attempt to determine whether abuse has occurred. The CPS social worker will do so in a number of ways. First, the social worker usually goes to the child’s school to speak with the child away from the person being investigated. The social worker must ask the child if s/he would be more comfortable with someone else in the room, and, if so, grant that request. Next, the social worker will begin speaking with people who can support the allegations of abuse (such as the person who made the allegation, witnesses, police officers, school personnel, doctors, etc.). Only then will the social worker speak with the parents, and will usually do so by showing up unannounced at the parents’ home. It is important to note that people are under no obligation to speak with social workers (meaning you don’t have to speak with them, and it might not be in your interest to do so), and individuals can demand that an attorney be present during these conversations. During the investigation, a social worker may try to get the parents to agree to a “safety plan” which puts in place rules regarding child custody and visitation to remain in effect until the investigation’s end. At the end of thirty days (or thereabouts), the social worker will find that the allegation of abuse is “substantiated” (meaning the social worker believes the abuse occurred), “inconclusive” (meaning the social worker doesn’t know whether the abuse occurred), or “unfounded” (meaning the social worker does not believe that any abuse occurred). Adoption
Adoptions sever the existing legal parent-child relationship to create a new one. In other words, the adopted person’s biological parents (or, in the case of a stepparent adoption – parent) will no longer be recognized as the parents, and the adoptive parents will assume that role. The parental rights of the biological parent(s) are permanently terminated and no longer exist. The easiest way to think about this is that the adopted person (adoptee) can be issued a new birth certificate containing the names of his or her adopted parents rather than the names of his or her biological parents. Once parental rights are terminated, the biological parents to an adopted child no longer have any absolute right to custody of the adopted person, visitation with the adopted child, or even to learn any information about the adopted child such as where the child lives, how the child is doing in school, etc. Types of Adoptions

Child Abuse
When an individual is found to have committed child abuse (physical abuse, emotional abuse, sexual abuse, or severe neglect), the case can be referred to Juvenile Court or not depending upon the severity of the abuse and the perceived need for court involvement with the parents. If the case is sent to Juvenile Court, then a parent would fight any allegation(s) of abuse in court, and Tot Law, APC attorneys are specialists in this fight. However, if the abuse case is not referred to Juvenile Court, then individuals found to have committed abuse are sent a letter indicating that their names have been sent to the Child Abuse Central Index – a list held by the Department of Justice which is accessed any time anyone undergoes a background check, applies for certain jobs, requests to be cleared to volunteer with children, etc., and that their names will remain on this list for the rest of their lives. If this occurs, the accused individual must contest this allegation of abuse in proceedings known as “CACI Grievance Hearings.”

Mrs. Swiller was raised in National City, CA where she attended Sweetwater High School before earning her associate’s degree in paralegal studies. While working as a paralegal, Mrs. Swiller also earned her undergraduate degree as a double major in Political Science and Philosophy at the University of San Diego where she was also a member of Phi Alpha Delta, pre-law society. Before attending law school, Mrs. Swiller worked at the Center for Community Solutions, where she held domestic violence clinics throughout San Diego County. At the clinics, Mrs. Swiller would provide assistance in preparing requests for restraining orders and offer resources to help victims secure housing and financial assistance.
